Terms of Service
Effective date: June 14, 2026
These Terms of Service (“Terms”) are a binding agreement between you and Protocol Health Ltd. (“Protocol Health,” “we,” “us,” or “our”) governing your use of myprotocol.health and our related services (the “Service”). Please read them carefully. They include an arbitration agreement and class-action waiver (Section 17) and important disclaimers that limit our liability. By creating an account, purchasing, or using the Service, you agree to these Terms.
1. Eligibility and acceptance
By using or purchasing the Service, you represent that you are at least 18 years old, are located in the United States, and have the legal capacity to enter into these Terms. The Service is not intended for anyone under 18. See our Age Policy. If you do not agree to these Terms, do not use the Service.
2. Definitions
- Service
- The Protocol Health website, application, and the generation of educational protocols.
- Protocol
- The educational document generated for you describing compounds and information related to a hypothetical Research Subject.
- Research Subject
- A hypothetical individual whose characteristics are modeled from the information you provide. A Protocol describes the Research Subject and is not advice directed to you or any real person.
- Educational Information
- Informational, educational content that is not medical, clinical, or professional advice.
- Content
- All text, data, and materials made available through the Service.
3. The Service is educational, not medical advice
Protocol Health is an educational research simulator that provides educational information, not medical advice. The Service uses artificial intelligence to generate a Protocol that describes a hypothetical Research Subject modeled from the information you provide.
The Service is not a substitute for professional medical advice, diagnosis, treatment, or prescription. A Protocol is not individualized medical advice and is not a recommendation that you or anyone obtain, use, or take any compound. Always seek the advice of a licensed physician or other qualified healthcare provider before making any decision based on the Content, and never disregard professional medical advice because of something you read on the Service.
4. No professional relationship
Your use of the Service does not create a doctor-patient, pharmacist-patient, or any other professional relationship between you and Protocol Health. Protocol Health is not a healthcare provider, pharmacy, telehealth service, or HIPAA covered entity, and does not provide treatment, diagnosis, or prescriptions. See our HIPAA Notice.
5. AI-generated content and its limitations
Protocols are generated by a third-party artificial-intelligence model provided by Anthropic, PBC, based on the self-reported information you enter. To generate your Protocol, the information you enter is transmitted to Anthropic for processing.
AI-generated content may be inaccurate, incomplete, outdated, or “hallucinated,” and is not reviewed by a licensed clinician. You are responsible for independently verifying any information in a Protocol with a qualified professional before relying on it. We do not warrant that the Content is accurate, reliable, current, complete, or suitable for any purpose.
6. Supplement and peptide disclaimers
The Content may reference dietary supplements, peptides, and other compounds. The following disclaimers apply:
These statements have not been evaluated by the Food and Drug Administration. This information is not intended to diagnose, treat, cure, or prevent any disease.
Many compounds referenced through the Service, including peptides, are not approved by the U.S. Food and Drug Administration for the uses discussed. Some are designated “research use only,” and some may be restricted, controlled, or illegal in your jurisdiction. The Content is educational and is not an offer, recommendation, or encouragement to obtain, possess, or use any compound.
You are solely responsible for determining and complying with the laws that apply where you live before obtaining or using any compound. Any reclassification of peptides or other compounds by U.S. authorities (including developments in 2026) does not mean a compound is FDA-approved or legal for your use.
7. Assumption of risk
You understand that any decision to obtain or use a supplement, peptide, or other compound carries risk. To the fullest extent permitted by law, you knowingly and voluntarily assume all risk arising from your use of the Content and from any decision you make based on it, and you agree that you proceed at your own risk and only after consulting a qualified professional.
8. Disclaimer of warranties
The Service and all Content are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory.
To the fullest extent permitted by law, Protocol Health disclaims all warranties, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the Content is accurate, complete, reliable, current, safe, effective, or error-free. You assume all risk for your use of the Service.
9. Limitation of liability
To the fullest extent permitted by law, Protocol Health and its officers, directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or health outcomes, arising out of or relating to the Service or the Content, even if advised of the possibility of such damages.
In no event will Protocol Health’s total aggregate liability for all claims relating to the Service exceed the greater of the amount you paid to us in the twelve months before the claim or one hundred U.S. dollars (US $100).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; in that case our liability is limited to the greatest extent permitted by law.
10. Indemnification
You agree to indemnify and hold harmless Protocol Health and its officers, directors, employees, and suppliers from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use or misuse of the Service, your violation of these Terms or any law, your infringement of any third-party right, or any decision you make to obtain or use any compound.
11. Payment, fees, and refunds
The Service is offered for a one-time fee to generate your Protocol. Payment is processed by Stripe; by purchasing, you authorize the charge and agree to Stripe’s applicable terms. Prices are stated at checkout and may be subject to applicable taxes.
Because a Protocol is a digital product that is generated and delivered to you on purchase, all sales are final and we do not offer guaranteed refunds. Protocol Health may, in its sole discretion, provide a refund only where it determines that a technical error on our part prevented delivery of your Protocol. To request consideration, contact support@myprotocol.health. Nothing in this section limits any non-waivable rights you may have under applicable consumer-protection law.
12. Intellectual property and license
Protocol Health owns the Service, including its software, design, text, and the format and templates used to produce Protocols. We grant you a limited, personal, non-exclusive, non-transferable, non-commercial license to access and use the Service and to view and download the Protocol generated for you for your own personal, educational use. You may not resell, redistribute, sublicense, or commercially exploit the Service or any Protocol, or remove any proprietary notices.
13. Acceptable use
You agree not to:
- use the Service or any Protocol as, or represent it as, professional medical advice;
- use the Service if you are under 18;
- use the Service where the Service or any referenced compound is unlawful;
- resell or redistribute Protocols or scrape or harvest Content;
- reverse engineer, decompile, or attempt to access the Service’s source or underlying models; or
- interfere with, disrupt, or attempt to gain unauthorized access to the Service or its security.
14. Accounts and security
You create an account through our authentication provider, Clerk. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account, and you agree to notify us promptly at support@myprotocol.health of any unauthorized use.
15. Third-party services
The Service relies on third-party providers, including Anthropic (AI), Stripe (payments), Clerk (authentication), Resend (email), Neon (database), and Google Cloud (hosting). Your use of features provided by these third parties may also be subject to their terms. We are not responsible for the acts, omissions, or failures of third-party services.
16. Privacy
Our handling of your information is described in our Privacy Policy, our Consumer Health Data Privacy Policy, our HIPAA Notice, and our Age Policy, each of which is incorporated into these Terms by reference.
17. Dispute resolution; arbitration and class-action waiver
Please read this section carefully — it affects your legal rights. Except for the carve-outs below, you and Protocol Health agree that any dispute, claim, or controversy arising out of or relating to the Service or these Terms will be resolved by binding individual arbitration, and not in court, except that either party may bring an individual claim in small-claims court. The arbitration will be administered under the rules of a recognized arbitration provider and governed by the Federal Arbitration Act and Wyoming law.
Class-action waiver.You and Protocol Health agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person’s claims.
Carve-outs. This section does not require arbitration of: (a) claims that may be brought in small-claims court; or (b) claims for injunctive or equitable relief to protect intellectual-property rights.
30-day opt-out. You may opt out of this arbitration agreement by emailing support@myprotocol.health within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration. Opting out will not affect any other part of these Terms.
18. Governing law and venue
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. Subject to Section 17, the state and federal courts located in Wyoming will have exclusive jurisdiction over any dispute not subject to arbitration. Nothing in this section waives any non-waivable consumer-protection rights you have under the law of your home state.
19. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the effective date above and, where appropriate, provide additional notice. Your continued use of the Service after an update means you accept the revised Terms.
20. Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms or to protect the Service or other users. You may stop using the Service at any time. Sections that by their nature should survive termination (including disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
21. General
These Terms, together with the policies incorporated by reference, are the entire agreement between you and Protocol Health regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a business transaction. We are not liable for delays or failures caused by events beyond our reasonable control. We may provide notices to you by email or through the Service.
22. Not for emergencies
The Service is not for medical emergencies. If you are experiencing a medical emergency, call 911 or your local emergency number, or contact a licensed healthcare provider immediately.
